Defects periods & responsibility

Different elements — primary structure, envelope, MEP services, specialist cold chain, finishes — often carry different defect or maintenance periods. Your defects schedule, specifications, and minutes of practical completion record the commercial position. Where SKKB is engineer of record or supervising consultant, we coordinate contractor responses within the scope of our appointment; where we are contractor, remedies follow your building contract and any statutory warranties that apply.

How to report a defect

Contact the Amman office by telephone or email (see the Contact page). Include the project name, site location, date the issue was noticed, photographs, and whether there is an immediate danger to people or the facility. For urgent life-safety or major refrigerant release risks, telephone first, then follow up in writing. We will acknowledge receipt where our contract requires it and route the report to the responsible site or design lead.

What is typically excluded

Fair wear and tear; damage by third parties, force majeure, or owner-operated equipment outside our supply; defects arising from unauthorised changes, overload, or misuse; and items expressly listed as owner risk in your contract are commonly excluded. Confirm exclusions with your lawyer before disputing payment or retention.

Records & dispute resolution

Keep copies of correspondence, photographs, and test results — they materially assist in distinguishing defect from damage or misuse. SKKB prefers commercial resolution: technical meetings, joint site visits, and where necessary mediation before escalation. If a dispute reaches litigation or arbitration, it will be determined under the dispute clause of your contract and the courts or tribunal named there.

Time bars & written notice

Nothing on this page extends or shortens contractual or statutory limitation periods. Preserve your position by giving written notice within the defect or claims windows your agreement and Jordanian law require — informal chats or messaging apps may not satisfy formal notice clauses. If in doubt, send a dated email to the lead contact and keep read receipts or delivery logs your counsel accepts.
